By accessing or using TNH SmartPlan ("Service"), operated by TNHIQ LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
TNH SmartPlan is a decision-support and financial intelligence tool for transportation operators. The Service provides estimates based on user inputs, recorded evaluations, and deterministic calculations. The AI Advisor feature explains your numbers and proposes app actions.
TNH SmartPlan is not a broker, dispatcher, carrier, insurer, lender, financial advisor, accountant, or law firm. We do not guarantee profitability, loss prevention, compliance, or loan approval.
All outputs, projections, scores, and recommendations are estimates for informational purposes only. They do not constitute financial, legal, tax, accounting, or regulatory advice. You are solely responsible for verifying all information and making your own business decisions.
The AI Advisor feature uses artificial intelligence to interpret your data. AI outputs may be inaccurate, incomplete, or outdated. You are responsible for verifying AI-generated content before acting on it. AI outputs do not constitute professional advice of any kind.
You are responsible for: (a) the accuracy of data you enter, (b) maintaining the confidentiality of your account credentials, (c) all activity under your account, and (d) compliance with applicable laws governing your business operations.
New accounts receive a free trial period. After the trial, continued access requires a paid subscription via Stripe. Subscriptions renew automatically. You may cancel at any time through the Billing page; access continues until the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TNHIQ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless TNHIQ LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your data inputs, your violation of these Terms, or your business operations.
You may not: (a) reverse engineer, decompile, or disassemble the Service, (b) scrape, crawl, or automated-access the Service, (c) use the Service for any unlawful purpose, or (d) resell access without written permission.
We may suspend or terminate your account at our discretion for violation of these Terms. You may delete your account at any time from the Settings page. Upon deletion, your data will be permanently removed within 30 days, except as required by law or for legitimate business purposes (e.g., billing records).
We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or in-app notice.
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Texas.
